Weinstein Defense Can Use Governor’s Wife’s Email At Trial

FILE – On March 2, 2014, movie mogul Harvey Weinstein arrived at the Oscars in Los Angeles much to fanfare. However, five years after women accused him of sexual harassment and misconduct – resulting in the #MeToo movement – he will stand trial on those charges. The eight-week-long jury selection process begins Monday, Oct. 10th, 2022.

LOS ANGELES (AP) — Jurors in Harvey Weinstein’s trial will be allowed to hear that two years after he allegedly raped and sexually assaulted her, Jennifer Siebel Newsom emailed the movie magnate for advice about how to deal with the media during a scandal involving her husband, California Gov. Gavin Newsom, Judge ruled Monday.

The judge granted limited permission to the defense to introduce evidence of an email sent in 2007 from when Gavin Newsom was mayor of San Francisco and dating Siebel Newsom.

But the defense was not allowed to discuss Los Angeles Superior Court Judge Lisa B. Lench’s forbidance of the email issue related to an affair Newsom had in 2005 with an aide. lench called it “too tangential about this trial

Weinstein’s attorney Mark Werksman argued passionately for the inclusion of the details.

“It would be the last thing you’d expect a woman who was raped by Harvey Weinstein to do, but the fact is she called him and asked how to deal with a sex scandal,” Werksman said.

Marlene Martinez, Deputy District Attorney, answered in response to Mr. Werksman’s comment about how a rape victim would behave: “I don’t know how Mr. Werksman could be aware of that information. Rape victims do not tend to react the way people who have not been raped might think.”

Werksman argued that the contents of the email are vital, claiming that for Siebel Newsom and the other individuals accusing Weinstein on trial, their power dynamic with him was crucial.

“When her boyfriend the mayor seduces an underling’s wife and gets scandalized over it,” she sides with the mayor,” he said. The attorney suggested that Judge allow this line of questioning to continue as it was essential to Weinstein’s rights.

The judge responded by saying the due process wasn’t at stake as much as the attorney thought.

“Werksman, yourHonor forgive the melodrama.” “Very dramatic, Mr. Werksman,” Lench said in response to his comment.

Weinstein is charged with raping Siebel Newsom at a Beverly Hills hotel in 2004 or 2005–11 counts of rape and sexual assault involving five women total. He is already serving a 23-year prison sentence for a rape and sexual assault conviction in New York.


In 2006, documentary filmmaker and actor Siebel Newsom began dating Gavin Newsom, who was elected governor in 2018.

The judge also ruled that the prosecution could play for jurors a secret recording that another forthcoming witness in the trial, Ambra Battilana Gutierrez, made of Weinstein in conjunction with New York police in 2015. In the recording, Weinstein apologized for his conduct during a previous meeting where she said he had touched her thigh and grabbed her breasts without consent.

Prosecutors investigated an incident involving Weinstein but ultimately decided not to bring any charges. This decision came under scrutiny in 2017 when allegations against Weinstein surfaced as part of the #MeToo movement.

“It seems to me that to the extent that it constitutes an admission, it is admissible,” the judge said.

Deputy District Attorney Paul Thompson said he could play just a short excerpt from the recording, but after a discussion with the defense, they agreed he should play all 43 minutes of it.

Gutierrez, an Italian model, is one of four women who are allowed to testify about being sexually abused by Weinstein during his trial. The Associated Press does not name people who allege they have been sexually abused unless the person has come forward publicly. Seibel Newsom’s identity was first reported…etc

After a day and a half of debating which evidence will be allowed during the trial, including one motion in which actor-director Mel Gibson was approved as a prosecution witness, the judge and jurors resumed jury selection in the afternoon. Siebel Newsom came up again during the process. “What if I told you that Governor Newsom’s wife is going to be one of those witnesses?” Weinstein’s attorney Alan Jackson asked the jury panel. “By the way, she will be.”


The questionnaire given to jurors last week proved that they will not be biased in their judgment. When asked if their opinion of the governor or his wife would affect their performance in jury duty, everyone said no. Out of the five people who had never heard of the #MeToo movement, none said it would guide their decision-making process.

The opinions were split among passionate people.

“I passionately believe in feminine voices being outspoken,” one woman said.

Another woman wasn’t as respectful to those who choose to speak up “after 10 years.”

“They’re just looking for their 15 minutes of fame,” she said.
